Brexit - What You Need To Know

Date: July 13, 2016

As a member of Pangea Net, an international network of law firms, Whiteford Taylor & Preston has working relationships with lawyers globally.  We are pleased to share insights from two Pangea Net members, English firms Browne Jacobson and Barker Brettell, on the legal implications of Brexit for topics ranging from trademark enforceability to corporate issues generally.  See below for more.

When hosting our more together reception at INTA in Orlando back in May we were asked many times about Brexit. We knew it was going to be close, but the opinion polls all indicated that ultimately the people of the UK would vote to remain in the EU. However the unexpected happened.

This historic development has led to so many practical questions: how will Brexit impact the IP protection of those that do business in the UK? What should international businesses be considering in respect of their existing commercial contracts and those they need to negotiate soon? What happens now in respect of the UPC? Does this impact on the new general data protection regulation? We therefore thought it would be good to share our current thinking with our international friends both within the EU and further afield, as to what changes can be expected and how businesses can seek to address them.

To help answer some of these questions take a look at Barker Brettell’s Q&A in respect of all the trade mark related questions Brexit is likely to raise.

Also see Browne Jacobson’s summary round up of our thinking in relation to Brexit and IP (more generally), as well as commercial contracts, data protection, IT and employment law. From this summary you can access more detailed guidance on each of those key areas.

Please also take a look at the Brexit - what you need to know Browne Jacobson web hub which we will be continuing to add useful resources to. If you have any suggestions on any area or issue Browne Jacobson or Barker Brettell have yet to address, please let us know.
