Employment Issues in Higher Education

Employee Benefits
We understand that hiring and retaining faculty, administrators, and staff is a constant concern. Our lawyers have helped colleges and universities negotiate employee contracts and retirement plans and conform to the complex requirements for setting executive compensation.

Employee Relations
We advise institutions of higher education on all areas of employment law, including promotion and tenure disputes, discrimination and harassment, compensation-related issues, government reporting requirements and affirmative action, occupational safety and health matters, and employment policies and work rules. We represent our clients in litigation before government agencies and the courts. For institutions whose employees are represented by unions, we provide representation in collective bargaining negotiations, grievance arbitration, labor disputes, and labor board proceedings. Additionally, our attorneys offer advice in union avoidance and union representation matters and represent institutions in unfair labor practice proceedings.

Immigration
Our attorneys are well-experienced in guiding U.S. and foreign employers through the maze of immigration laws. We also assist higher education institutions as they determine the best practices to hire and employ foreign faculty and other professionals and skilled foreign workers, on a temporary or permanent basis. In addition, we counsel human resources departments on compliance with immigration laws, including immigration-related discrimination concerns, employment eligibility verification, DOL and ICE investigations, employer penalties and fines, and immigration record keeping.
