Experience

Scott focuses on business and commercial litigation, land use and zoning, real estate litigation, construction litigation and insurance defense litigation. He represents national and local clients with lease drafting and negotiations, land use and zoning disputes, real estate disputes, construction matters, including contract drafting and negotiation, contract performance matters, mechanic's lien actions/defense, construction defect and warranty claims and delay claims. He also handles landlord/tenant matters and debt recovery cases.
 
Earlier in his career, Scott was a First Assistant County Attorney for New Castle County. In this position he represented and counseled the Department of Land Use in all facets of the building and subdivision codes and appeared on behalf of the Department before various administrative bodies such as the Planning Board, Board of License, Inspections and Review and Historic Review Board. He also represented the Departments of Special Services and Police while employed by New Castle County.

Business and Municipal Litigation

  • Successfully defended a multi-national company in complex litigation regarding hundreds of claims of environmental exposure.
  • Successfully represented a leading owner and operator of communications sites for the wireless and broadcast industries in contract litigation.
  • Collected hundreds of thousands of dollars for individual and corporate clients in landlord/tenant and breach of contract matters.
  • Successfully represented employers defend against claims before the Unemployment Industrial Appeals Board and the Superior Court regarding employment claims.
  • Represented municipal, county and state government agencies in various litigation matters.

Real Estate Litigation

  • Representation of national builder in defending against construction litigation
  • Successfully defended a national builder in defending against a breach of contract claim seeking hundreds of thousands of dollars.
  • Represent builder in litigation against another builder regarding the interpretation of contract documents.

Construction

  • Successfully represented local contractors in defending against numerous mechanic's lien cases filed on a construction project in Delaware.
  • Counseled local company on drafting and negotiations construction contract.

Land Use

  • Representation of numerous national and local developers/builders with land use issues before the New Castle County Planning Board, New Castle County Board of Adjustments and City of Wilmington Planning Board.
  • Representation of builders with zoning approvals and rezonings.
  • Represented a national organization as amicus curiae before the Delaware Supreme Court in a dispute over the application of land use regulations.
