Creditors' Rights

We represent community banks, trust companies, financial institutions and trade and general creditors in the recovery and preservation of financial interests in troubled companies.  When negotiated solutions are not viable, we have the ability and experience to litigate aggressively and efficiently.  We have served as counsel to landlords in retail bankruptcies, utility companies, lenders, vendors and bondholders in cases spanning virtually every industry. 
We also regularly defend parties that have been threatened with a lawsuit or named as a defendant by a debtor, trustee or receiver to avoid and recover preferential transfers and fraudulent conveyances.  The attorneys in our Creditors’ Rights group deploy practical and cost-efficient approaches to resolving these “claw-back” actions until such time as strategic and aggressive litigation is required.
