Professional Liability

Whiteford, Taylor & Preston has extensive experience in the prosecution and defense of professional and fiduciary liability claims, including against lawyers, medical, professionals, corporate directors and officers (see Corporate Governance Litigation), accountants, architects, engineers, real estate and other professionals.

Given the broad array of our experience, we understand and appreciate the complexities of representing professionals alleged to have breached applicable standards of care or fiduciary duties: our litigators have handled hundreds of such cases on behalf of our professional clients.

Our attorneys have the accounting, business, and legal experience necessary to aggressively pursue redress for clients who have been financially harmed due to professional negligence and/or misconduct, and to defend clients against such allegations. Several of the attorneys in this practice group have accounting backgrounds, including Certified Public Accountants.

Because of our experience in prosecuting and defending professional liability claims, we are uniquely positioned to understand how best to present such matters from either side of the table. In addition to routinely defending professional firms throughout the region, we represent companies, investors, shareholders, creditors, and trustees in connection with claims involving the failure to provide accurate advice on financial aspects of corporate restructuring, failed audits, improper opinions of financial statements, violations of federal and state securities laws, corporate governance matters, and fraud.

We handle cases in federal and state courts nationwide, as well as arbitrations and mediations pursuant to the terms of professional engagement letters.
