Mr. Whiteford focuses on real estate, business, commercial, employment and insurance related litigation matters.  He represents national and local clients in negotiations and litigation involving land use disputes, real estate, riparian rights and construction defects.  He also handles litigation involving cemeteries and funeral homes.  He regularly advises a range of companies, particularly real estate developers, commercial lessors, cemeteries and providers of funeral services, with regard to potential litigation and other business-related decisions.  Mr. Whiteford is also experienced in the representation of licensed medical professionals before a range of governing bodies both in hearings and on appeal.  He serves on the Boards of two continuing care retirement communities.

  • Includes matters related to governmental takings as a result of environmental contamination and the valuation of and clean-up costs associated with environmental contamination of real property.
 

Lead Paint Litigation

  • Representation of individual owners and corporate property owners in the defense of lead paint litigation throughout the State of Maryland
  • Includes the defense of uninsured claims, as well as claims handled through all the major insurance companies defending such claims.
 

Real Estate Development, Leasing and Land Use

  • Working closely with our Land Use attorneys handling the development process, assist national and local clients in negotiations and litigation involving land use disputes, boundary disputes, zoning issues, condemnation, riparian rights, landlord/tenant disputes and construction defects in the various State and Federal courts in Maryland.
 

Condemnation/Eminent Domain

  • Representation of property owners, including State entities in eminent domain and condemnation proceedings before Circuit Courts throughout Maryland.

Lead Paint: The Court Throws the Rental Market into Turmoil

On October 24, 2011, Maryland’s highest court, the Court of Appeals, issued its decision in Jackson v. Dackman Co., and found that the immunity provisions of The Reduction of Lead Risk in Housing Act (the “Act”) are unconstitutional.  Previously, the Act provided property owners with immunity from lead based paint claims if they complied with its provisions and/or if a qualified offer was made.  However, for reasons discussed in more detail below, the Court held that the immunity provisions of the Act are unconstitutional because the statutory remedy provided by the Act is unreasonable.
