Student Housing

Our student housing team provides clients with practical and strategic advice across a broad range of subject areas, including development agreements; joint ventures; public and private finance; zoning, subdivision and land use; property management; and general advice in areas such as environmental and tax. Team members are drawn from multiple practice areas and legal disciplines including real estate, finance, environmental, corporate and tax, in order to provide effective counsel to state level institutions, public and private universities, developers, owners, and operators in connection with public and private student housing projects and other complex development projects. 

We regularly act as lead counsel on behalf of our institutional clients to structure and document the development and financing of student housing projects located on university campuses.  Our services include drafting and negotiating ground leases, development agreements and property management agreements.  Many of our financing structures include ground leases with the educational institutions, and we are familiar with managing the parties’ interests regarding debt capacity and limits, operational control, coordination with resident life programs, risk management and procurement.  

We work with both public offering and private placement bond issues, and effectively utilize tax-exempt and taxable structures.  Our experience includes advising on complex and challenging legal issues requiring innovative solutions for achievement of our clients’ business goals.
